AI Flex Chart — Terms of Service

1. Overview

These Terms of Service ("Terms") govern your access to and use of AI Flex Chart (the "Service"), including the Power BI custom visual and associated backend API, provided by Gjorgji Rankovski, a sole proprietor based in Oslo, Norway ("we", "us", or "our"). By using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization and "you" refers to that organization.

2. Service Description

AI Flex Chart is a custom Power BI visual that uses artificial intelligence (AI), including large language models, to generate D3.js-based visualizations from dataset metadata and your natural-language prompts or instructions.

The Service processes primarily metadata from your Power BI data model — such as column names, table names, measures, data types, and row counts — together with your prompts, in order to generate and render visualizations (including labels, legends, and tooltips). Row-level data values are designed to remain within your Power BI environment and are not transmitted to our backend in normal operation, unless you deliberately include such values in prompts or column names.

You see only the resulting visualizations inside Power BI; the underlying code generated by the AI models is not exposed to you.

3. Accounts, Eligibility, and Subscriptions

You must be at least 18 years old and have the legal capacity to enter into these Terms. Access to certain features may require registration and/or a paid subscription. You agree to provide accurate and up-to-date information and to keep your account credentials secure.

Subscriptions renew automatically at the end of each billing period unless cancelled in accordance with these Terms. We may modify, suspend, or discontinue the Service or any feature at any time, with or without notice, subject to applicable law.

4. Fees, Billing, and Refunds

You agree to pay all applicable fees for the Service in accordance with the pricing and billing terms presented to you. Unless explicitly stated otherwise, all fees are non-refundable and non-creditable, including for partial periods, unused services, or downgrades, except where required by applicable law (including mandatory Norwegian and EU consumer protection rules where they apply).

You may cancel your subscription at any time; your access will continue until the end of the current billing period, and you will not receive a refund for any remaining time, unless required by applicable mandatory law.

We may change prices and billing terms; any changes will apply from the next billing period after we provide reasonable prior notice.

5. AI-Generated Content and Your Responsibility

The Service uses large language models and other AI technologies ("AI Models") to generate visualization behavior based on metadata and your prompts or instructions. You acknowledge and agree that:

AI-generated outputs may be incorrect, incomplete, misleading, harmful, biased, or otherwise unsafe, and may not be suitable for your specific use case.
The Service does not provide legal, financial, engineering, statistical, or any other form of professional advice. Outputs are for informational and visualization purposes only.
You are solely responsible for reviewing, validating, and testing any visualization and for ensuring that its use is appropriate for your business, technical, regulatory, and security requirements.
You must not rely on the Service or its outputs as a substitute for professional judgment or independent verification.

Without limiting the foregoing, you are solely responsible for any decisions or actions you take based on the visualizations produced by the Service, and for ensuring that your use of the visualizations complies with all applicable laws, regulations, internal policies, and third-party terms (including Microsoft Power BI and any other tools you use).

6. User Content, Metadata, and Column Names

"User Content" includes any information, data, text, labels, column names, table names, measures, prompts, and other material that you or your organization provide or make available to the Service.

The Service is designed to operate primarily on dataset metadata, such as column names, data types, table names, measures, and row counts. We recognize that column names, table names, and similar labels may contain or reflect your proprietary or customer-specific information. We process such metadata and column names in order to generate and render visualizations (for example, to produce axis labels, legends, and tooltips).

Except to the extent you explicitly include it in prompts, column names, or other metadata fields, the Service is not intended to receive or store raw row-level data values from your datasets.

You retain all rights to your User Content. You grant us a non-exclusive, worldwide, royalty-free license to use User Content solely to: (a) provide and maintain the Service; (b) prevent or address security or technical issues; and (c) comply with legal obligations.

7. Acceptable Use

You agree not to:

Use the Service in any way that violates applicable law, regulation, or third-party rights, including privacy, intellectual property, and export control laws.
Use the Service to generate or assist with any illegal, harmful, discriminatory, or abusive activities.
Attempt to gain unauthorized access to any systems, accounts, or data; interfere with or disrupt the integrity or performance of the Service; or circumvent usage limits or authentication.
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any part of the Service, except to the extent such restriction is prohibited by law.
Resell, sublicense, or offer the Service on a service bureau basis without our prior written consent.

We may suspend or terminate your access to the Service if we reasonably believe you are in violation of these Terms or are otherwise engaged in abusive or harmful behavior.

8. Intellectual Property

We and our licensors own all rights, title, and interest in and to the Service, including the software, backend systems, user interface, documentation, and all related intellectual property. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to use the Service for your internal business purposes during your subscription term.

We do not claim ownership of your underlying datasets or Power BI reports. While you do not see the underlying code generated by AI Models, you may use the resulting visualizations within your Power BI environment subject to these Terms and applicable third-party licenses.

9. Third-Party Services

The Service may depend on or interoperate with third-party services, such as AI model providers, cloud hosting, and payment processors ("Third-Party Services"). Your use of Third-Party Services may be subject to separate terms and privacy policies. We are not responsible for the availability, performance, or behavior of any Third-Party Services.

10. Disclaimers

THE SERVICE AND ALL OUTPUTS (INCLUDING VISUALIZATIONS GENERATED BY AI MODELS) ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE OR ANY OUTPUT WILL BE ACCURATE, RELIABLE, ERROR-FREE, SECURE, UNINTERRUPTED, OR SUITABLE FOR YOUR PARTICULAR PURPOSE OR COMPLY WITH ANY LEGAL OR REGULATORY REQUIREMENT.

11. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will we be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the amounts paid by you for the Service during the three (3) months immediately preceding the event giving rise to the claim, except where a higher limit is mandated by applicable mandatory law.

12. Indemnification

You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or any visualization produced by it, your violation of these Terms or any applicable law or regulation, or your infringement or misappropriation of any third-party rights.

13. Governing Law, Jurisdiction, and Local Laws

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of Norway, without regard to its conflict of laws principles.

You and we irrevocably agree that the courts of Oslo, Norway will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Service, except that we may seek injunctive or equitable relief in any court of competent jurisdiction.

Nothing in these Terms limits any mandatory consumer protection rights or other non-waivable rights you may have under the laws of your country of residence. The Service is intended for global use, but you are responsible for ensuring that your use of the Service complies with all laws and regulations applicable to you.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (for example, via email, in-app notice, or on our website). Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.
